Dealing with Debt Collectors

 

Getting a call from debt collectors can be one of the most frightening things. It is even worse when they become rude or threaten you. The thought of losing your property is bad enough. Debt collection is supposed to be carried out in a humane manner. So how do you deal with such debt collectors?

Always respond to their communication. Do not wait until it is too late to start negotiating with them. They are also human and may get frustrated and angry at your lack of response. Responding to their calls as soon as possible is the best way to work out a payment strategy.

Debt recovery is governed by the Fair Debt Collection Practices Act that clearly states that they should not contact you between 9pm and 8am. You should therefore take note of the time they contact you.

Note and record any threats especially referring to bodily harm. They also should not use abusive or derogatory words. This is considered as malpractice in the debt collection industry.

Ensure that the amount they are requesting for is the actual debt that you owe. Any figure over and above that is illegal.

If you feel that the debt collector is being unreasonable or claiming money, which you do not owe and are unwilling to cooperate, you can report them to the Federal Trade Commission.
